Any new and original two-dimensional and/or three-dimensional creation (figure or article) of a particular shape, pattern, configuration, ornamentation, or composition of lines or colors which in the finished state appeals solely to the eye, can be given design protection under the Designs Law in India. As per the law, the owner of the design should apply for registration before the article in question is made public or commercialized. The Industrial Design is administered under the Design Act of 2000 and the rules made there under. Novelty and Originality are the two essential aspects that make an article eligible for registration with the Indian Design Office.
Design Filing: Filing for registration of a design can be made at the head office in Kolkata or at Chennai, Delhi or Mumbai following which the application will be forwarded to Kolkata office for processing and prosecution.
Duration: The registration granted for a design has the validity for a ten year period following which it can be renewed for additional five years.
