The Indian Copyright Act protects all original literary and artistic works including but not limited to cinematographic films and sound recordings. It is always advisable to register a copyright for its enforcement and protection against any fraudulent usage of the work. As a member of Berne Convention 1886 and the Universal Copyright Convention 1951, India also provides copyright protection to the works of foreign nationals belonging to the convention nations.
The owner of a copyright has various rights but not limited to Right of publication, Right of paternity, Right of integrity, Right to reproduce/issue copies of original work, Right to perform/Communicate the work in public, Right to translate/adapt the work into a literary piece or a film or sound recording;
Any person can file a copyright as per the rules and regulations of the Copyright Act in India. The copyright subsists in the work for the period of author’s lifetime and up to 60 or 50 years depending upon the cases.
